Most of the laws on the books don't protect the average working person at all. Let me tell you why. In the past month i was in a car accident. It was on a 2 lane road I was in the left lane making a left turn into a parking lot.  While i was waiting to make the turn a car from behind side swiped me. We both pulled over to the side to get out of the way and make sure no one was hurt. I immediately called the police and they arrived in a few minutes. The police made a report and gave me the information of the person who hit me. It was minor damage so we were able to drive our cars away. So I immediately call the insurance company of the person who hit me and make a report and give them all of the information and police report. They give me a case number.

Here is where the issue comes and why the law has to be changed. If the insurance company doesn't hear from the insured then they won't process the claim until they do even though they have a valid police report as evidence. I called the insurance company everyday to see if the insured called which he didn't for several days. I had taken the persons phone number at the time of the accident, so I had to call the person several times, as did the insurance company, to give the statement that it was there fault. In the state I'm in there is no law on the books that the person who hits you has to report the accident to there insurance company. And if they don't you would have to go through your insurance company to get your car fixed and then your insurance company would go after there insurance company to get the money back. But this could take weeks if not months to get the money back. But the money for the deductible that you have would have to come out of your pocket.

Here are some WHAT IF'S

  • What if I didn't have the money for the deductible
  • What if I didn't have the money for a rental car
  • What if I lost time at work to deal with these issues or because I wasn't able to get there.

and the list go's on.

The sad part is the insurance companies won't take a POLICE REPORT to get it resolved. I think they should make it a felony for people who don't report the accident in a timely manner and the Insurance Companies for not taking the police report as evidence. All should be arrested and prosecuted to the fullest extent of the NEW LAW. In the end it took several days for me and the insured insurance company to get a hold of this person to admit they were at fault.

WHERE IS THE JUSTICE??
